Apparently the Kang's lawsuit with the NCAA has reached an out of court settlement. The terms of the settlement are private. I would love to know the terms of the settlement.

Seven figures for JWS, a non disclosure agreement for remaining named defendants is my guess. When there’s a settlement after the commencement of trial, 9 times out of 10 it’s the defendant going into damage control mode. Very telling, IMO. Would’ve loved to have heard that testimony. Congrats, Jackie. You made NCAA ******* pucker.

Sure would like to know the testimony of Jahaningmeier, sp?, today. Should be a matter of public record. Doubt the CL would cover it and report!

Not seeing any news about this being settled, except 6Pk.

Well dang! I wanted to read about the comments witnesses made and see JWS knock their a$$es into next week!

Obviously, he had some really good info on them or they wouldn’t have settled before the kick off.

Reports are NCAA lied

So Grindle’s mom testified family bought his car not MSU. Most damning was transcript of interview Jahaningmeier had with grandfather of another recruit who denied 20 plus times MSU offered a car. We got charged with offering said recruit a car. So we got placed on probation, lost our coach, soiled the reputation of our school and lost untold revenue on charges based on an extremely biased and dishonest investigator. Seems we should have our record restored and get a very public apology from the NCAA. Whomever reviewed our case on appeal should have also been questioned on what evidence they relied on or did they just read the lying SOB’s report and take it at face value without looking at any evidence.

Looks like the last update on that article was yesterday morning. Something else should be coming out fairly soon.

If they did settle, it's amazing that something that dragged on for 15 years was settled in a matter of hours once it got in court. That's not exactly "speedy" as the Constitution requires.

Yes why couldn’t we sue the NCAA for damage to reputation leading to lost revenues and such??
also, couldn’t we sue OM or any booster of theirs that may have allegedly been involved in the scheme?

it just killed them that we won the west and went to Atlanta and they did everything they could to bring us down! Which they do for about 8-10 years!!

the speedy part relates to criminal cases that involve the state or federal governments...civil courts are two private parties arguing about money and damages....

It took 15 years to get to trial, which tells me that neither party was excited about actually going through with it. (In response to another post in this thread "speedy and public trials" only applies to criminal prosecutions). Although the latest CL article says the Tuesday testimony was damaging to the NCAA's case, I seriously doubt the NCAA was surprised by anything Sherrill's attorneys put on in the first day.

I would be surprised if the settlement was 7 figures, although I suppose it was possible. Sherrill was making less than $1 million per year at State, and he was 60 when he was terminated. If they agreed to give him some back pay plus interest then it might have been 7 figures; I just don't see it.

That's not exactly "speedy" as the Constitution requires.

Sixth and Seventh Amendments require different things. In a state court civil trial if the plaintiff isn’t pressing the issue it’s not uncommon to languish for years.

It probably won't ever be available. I don't practice in Mississippi, so I don't know for sure, but transcripts take time to prepare and once a trial is settled there isn't need for a transcript. The best you could probably hope for is notes from someone who was at the trial and isn't bound by whatever confidentiality agreement the parties sign (like a journalist).

The case settled. Nothing was established.

IIRC, the NCAA threw out the more damaging stuff that Johannigsmeir came up with, and that's why we only lost 4 scholarships over 2 years. The real damage to MSU was the 3 year on going investigation, and "true journalists" like Not a Fan claiming that it might be the harshest NCAA punishment ever.

And hiring, Croom, of course, but the NCAA didn't make us do that.

I’d be highly surprised if it was less than 7 figures. NDAs aren’t cheap. And Jackie could’ve easily coached 10+ more years at a USM/La Tech/Memphis type institution where he would’ve pulled in similar money to what he was making at State because of the spike in coach salaries.

Yeah, but first he would have to prove that he could have gotten those jobs and that the NCAA damaging his reputation was the primary reason he didn't get those jobs. That would also probably require him to show that the last 3 years of his time at State were ****** just because of the NCAA investigation...it was a factor, sure, but it wasn't the reason our highly touted 2001 team went 3-8 (Thanks, Osama!)

NDAs are not only cheap, they are pretty typcial in every settlement I've been involved in. Like I said, 7 figures is possible, but it would surprise me. There was a magic number that Sherrill was willing to accept, and I'm sure the NCAA paid something below that number.

Cal Mayo bought the NCAA roughly 15 years' worth of delay, obfuscation, vexation and typical Ole Miss Smartass behavior. Here's hoping the kang got all he wanted and more. I'm betting he got somewhere north of $3 large.

If he missed even $100k a year for 7 years and then calculate interest at 5% for another 9 years that’s easily 7 figures.

They could have cut the deal in the Judges' chambers or anywhere outside of the court room and earshot of journalist. We'll probably never know for sure all the nuts and bolts of the details of the settlement.

I'd be very curious as to the outcome details myself. I'm just glad Jackie had the balls to hang in there and fight for his day in court and ultimately, prevail.

Not established in a legal sense, but established in a message board sense...as in, the NCAA settled in what appears to be admitted wrongdoing and general flemflammery on their part....you know, message board guilt.

Yeah, OMs mouth pieces at sports 56 in Memphis, talked about our looming and crushing ncaa investigation ad nauseam during the Investigation. You would thought we were the most rogue program in the country at that time. It was really ridiculous.

I am guessing that Sherrill is a fairly wealthy guy and he has seen this thing through for 15 years....I would be surprised if he finally let it go for less than 7 figures.

This was my thought as well. Kinda found it hard to believe JWS would stick with this headache for 15 years for less than a mill.
